As a result of the procedure, parties confirmed the absence of mutual claims and concluded an agreement on further cooperation.
On November 19, a mediation procedure between Vandog Agency and MHP was successfully held within the Mediation Center of the Ukrainian IP Office (UANIPIO). Natalia Kovalko acted as a mediator. The dispute concerned a tender procedure in the field of creative services.
As a result of the mediation, parties confirmed the absence of mutual claims and concluded an agreement on further cooperation. They also agreed to jointly develop recommendations to improve the tender procedure in the marketing and creative industries. These recommendations can be used by other market participants, which will help ensure transparency and efficiency of tender processes in future.
Successful case of IP mediation demonstrates the effectiveness and prospects of pre-trial settlement of intellectual property disputes in Ukraine.
“The culture of mediation is necessary for all of us, for Ukrainian society in particular. It is not only about alternative dispute resolution, but also about avoiding conflicts, preserving business reputation and mutual understanding. Mediation guarantees confidentiality, speed, resource savings, and always takes into account the interests of all parties. Therefore, we welcome the first successful case on the basis of our Mediation Center and look forward to scaling up this experience. Numerous foreign examples convince us that we are on the right track, as the world’s leading countries have 30-40 years of successful IP mediation cases experience”, – emphasized Olena Orliuk, Director of the Ukrainian IP Office.

Mediation is an out-of-court, voluntary, confidential, structured procedure in which the parties, with the assistance of a mediator, try to prevent a conflict or resolve a dispute through negotiations. This is a new tool for the Ukrainian IP system that works in all developed economies and assists creators, inventors and businesses in resolving disputes.
The IP Office’s Mediation Center is a professional platform for resolving disputes through mediation.
Unlike judicial proceedings, which can run for months or even years, IP mediation usually takes several hours and several sessions, which allows for a quick and mutually beneficial solution.
