    Copyright and Related Rights – 2025: European Integration, Legislation, State Registration, Creative Industries and WIPO ALERT

     

    In 2025, the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO/IP Office) prepared proposals for the implementation of certain provisions of EU legislation in the field of copyright and related rights into national legislation, which underwent a series of expert discussions and refinements. The IP Office also registered more than 9,000 copyrights for works, adopted 16 conclusions “on piracy”, provided more than 4,200 consultations to representatives of the creative sectors of the economy.

     

    We invite you to learn more about the results of UANIPIO’s activities in the field of copyright and related rights, which focused, in particular, on:

     

    • Ukraine’s alignment with obligations within the framework of the European integration process;

     

    • carrying out voluntary state registration of copyright for works and agreements relating to property rights to works;

     

    • supporting creative industries;

     

     

    European integration dimension and adaptation of legislation

     

    In order to align the legal regulation of copyright and related rights with the EU acquis, UANIPIO worked on developing proposals for amendments to certain Ukrainian legislative acts in the field of copyright and related rights. This work was carried out in accordance with Subparagraph 1 of Paragraph 93 of the Action Plan for the implementation of the European Commissionʼs recommendations presented in the Report on Ukraine’s progress within the framework of the 2024 European Union Enlargement Package, approved by the Order of the Cabinet of Ministers of Ukraine No. 300-r dated March 28, 2025.

     

    In the process of preparing proposals there were analysed the experience of implementation the transposition practice into the national legislation of EU member states of a number of key directives relating to copyright and related rights, satellite broadcasting and cable retransmission, legal protection of databases, the information society, legal protection of computer programs, the term of protection of copyright and certain related rights, certain permitted uses of orphan works, the Digital Single Market, etc.

     

    Based on the results of this work and with a view to implementing these directives, UANIPIO has prepared proposals for the draft Law of Ukraine “On Copyright and Related Rights” (proposals as of June 9, 2025).

     

    Chronology of expert discussions 

     

    • On May 13, 2025, the IP Office held a discussion of proposals with the participation of representatives of State bodies, scientific institutions in the field of intellectual property, as well as artists, rights holders, users, and other stakeholders.

     

    • On June 6, 2025, a meeting was held between the representatives of UANIPIO and an international expert from the EU4IP project, during which the main provisions of EU acts requiring further implementation into national legislation were discussed.

     

    • On 16 June 2025, the English version of the IP Office’s proposals, taking into account comments received from State bodies, Collective Management Organisations and other interested parties, was sent to the international expert of the EU4IP project.

     

    • On June 30, 2025, a sectoral discussion of UANIPIO’s proposals was held with representatives of the State Archival Service of Ukraine.

     

    • On June 17, 2025 and June 27, 2025, the IP Office held discussions on the proposals with representatives of the Ministry of Economy, Environment, and Agriculture of Ukraine, the Ministry of Education and Science of Ukraine, the Ministry of Justice of Ukraine, the State Archival Service of Ukraine, the International Federation of the Phonographic Industry (IFPI), the Kyiv Professional Union “Screen Masters”, the public union “Music Association “Spilna”, the National Council of Ukraine on Television and Radio Broadcasting, the National Academy of Sciences of Ukraine, the Department of Intellectual Property and Information Law of the Educational and Scientific Institute of Law of Taras Shevchenko National University of Kyiv, Collective Management Organizations – the NGO “Ukrainian Agency for Copyright and Related Rights” (NGO-UACRR), the Collective Management Organisation “Oberih”, the “The Ukrainian Author’s Rights Agency” (UARA), as well as other stakeholders.

     

    • On July 4, 2025, UANIPIO received a draft report on the comparative analysis of the alignment of national legislation with EU legal acts in the field of copyright and related rights, prepared by Ioannis Kikkis, an international expert of the EU4IP project. On July 10, 2025, Ioannis Kikis also sent preliminary comments on UANIPIO’s proposals and answers to specific questions that were sent to international experts of the EU4IP project on 30.06.2025 to the IP Office.

     

    • On July 11, 2025, sectoral discussions of UANIPIO’s proposals were held with representatives of the Ukrainian State Film Agency and on July 14, 2025, with representatives of the National Council of Ukraine on Television and Radio Broadcasting.

     

    • On July 11, 2025, during an online meeting with international experts of the EU4IP project, positive feedback was received on the IP Office’s proposals, and the issue of clarifying certain provisions proposed by UANIPIO was discussed.

     

    • On July 18, 2025, the IP Office sent proposals to the Ministry of Economy regarding the draft Law of Ukraine “On Amendments to the Ukrainian Copyright and Related Rigths Legislation,” as well as a revised draft report on the comparative analysis of the alignment with national legislation in the field of copyright and related rights with EU legislation (EU acquis), preliminary comments on UANIPIO proposals, as well as comments on UANIPIO proposals received from interested parties who participated in the discussions.

     

    • On July 22, 2025 and July 28, 2025, UANIPIO together with the Ministry of Economy, finalized proposals to the draft Law of Ukraine “On Amendments to the Ukrainian Copyright and Related Rigths Legislation” for further submission to the European Commission.

     

    The IP Office reviewed the comments of experts from the Better Regulation Delivery Office (BRDO) on the proposals and prepared recommendations for incorporating the relevant comments into the final version of the proposals.

     

    The UANIPIO also reviewed the comments of Ioannis Kikkis, reflected in the draft comparative analysis of Ukrainian legislation on copyright and related rights with current EU law (EU4IP international technical assistance project: “Strengthening Intellectual Property Rights in Moldova and Ukraine”) and prepared proposals to take the relevant comments into account while finalizing the proposals.

     

    During September-December 2025, UANIPIO held additional consultations on finalizing proposals for the draft Law of Ukraine “On Amendments to the Ukrainian Copyright and Related Rigths Legislation” with EU4IP international expert Ioannis Kikkis, as well as specialists from the Ministry of Economy and BRDO:

     

    • On September 26, 2025 and November 28, 2025 – consultations with Ioannis Kikkis on the implementation of EU legislation in the field of copyright and related rights. Additional written responses from the international expert on the issues discussed during the consultations were reviewed. The expert’s responses were taken into account while finalizing proposals for amendments to legislative acts in the field of copyright and related rights.

     

    • On November 11, 2025 – working meeting with representatives of the Ministry of Economy, BRDO, and EU international experts involved in the EU4IP international technical assistance project on the exchange of experience in legislative regulation and practice of supervising the activities of Collective Management Organizations;

     

    • On December 5, 2025 – working meeting with representatives of the Ministry of Economy, BRDO, and EU international experts on the application in EU Member States of Regulation (EU) 2017/1128 of the European Parliament and of the Council of June 14, 2017 on ensuring cross-border portability of online content services in the internal market.

     

    As of the end of December 2025, UANIPIO has substantially refined these proposals, so in January 2026, it is proposed to discuss them with the representatives of creative industries, state bodies, Collective Management Organizations, the scientific community, and other stakeholders.

     

    State registration of copyright

     

    During 2025, UANIPIO received:

     

    • 10,855 applications for state registration of copyright in a work;

     

    • 398 applications for state registration of contracts relating to property rights in a work.

     

    As of December 19, 2025, the following had been processed:

     

    • 9,030 registrations of copyright for works;

     

    • 319 registrations of contracts.

     

    In addition, on November 3, 2025, an Order of the Ministry of Economy, Environment and Agriculture of Ukraine dated August 27, 2025, No. 337 “On Amendments to the Order of the Ministry of Economy of Ukraine dated August 16, 2023, No. 11319,” came into force and registered with the Ministry of Justice of Ukraine on October 9, 2025, under No. 1469/44875.

     

    Amendments and additions to the Procedure for State Registration of Copyright and Contracts relating to property rights in works were made in accordance with the Law of Ukraine “On Amendments of Certain Legislative Acts of Ukraine in connection with the adoption of the Law of Ukraine “On Administrative Procedure.”

     

    The changes adopted in the Procedure for State Registration are a step towards a more convenient, understandable and modern service for authors and rights holders. The reduction of application processing times, the introduction of contract registration certificates, the possibility of obtaining a new certificate to replace one that contained errors and the regulation of important procedural aspects of registration are all aimed at improving the quality of services and confidence in state registration.

     

    Countering piracy: the WIPO ALERT initiative

     

    In 2025, UANIPIO continued to implement the WIPO ALERT initiative aimed at counteracting the placement of advertisements on pirate websites, for which advertising revenue is an important source of income.

     

    In accordance with the approved Procedure for Forming and Maintaining the National List of Websites Causing Concern on Respect for Intellectual Property Right, UANIPIO ensured the consideration of requests from copyright and related rights holders to include websites in such a list.

     

    During the year, UANIPIO:

     

    • received 18 requests from copyright and related rights holders to include websites in the national list;

     

    • approved 16 conclusions on the grounds for including websites in the list.

     

    In 2025, the Ministry of Economy added 15 websites to the national list and to the World Intellectual Property Organization’s “WIPO ALERT” database.

     

    Support for creative industries

     

    Throughout 2025, UANIPIO’s specialised structural units focused on the development of creative sectors of the economy organised and/or participated in 30 educational events on intellectual property rights protection in various creative industries, including fashion, design, translation, media, scientific libraries and others.

     

    During the reporting year, special attention was paid to architectural activities. In February 2025, in cooperation with the National Union of Ukrainian Architects, UANIPIO held two seminars for architects, participated in the analysis of the draft Urban Planning Code of Ukraine and, as a result of consultations with representatives of the National Union, developed a draft license agreement for architectural works.

     

    In total, ten such agreements were developed during the year: in addition to architecture, they concerned publishing, translation rights, design rights, and visual arts.

     

    Traditionally, comprehensive methodological support was provided throughout the year to representatives of cultural industries, in particular museums, archives, and libraries. Thus, in February 2025, with the support of the State Archival Service of Ukraine, a seminar was held for employees of Ukrainian archival institutions, which resulted in regular joint consultations on the specifics of copyright compliance in archival work in wartime and the involvement of representatives of UANIPIO in an interdepartmental working group called upon to regulate the issue of accurate documentation of war events.

     

    At the request of the Ministry of Culture of Ukraine, UANIPIO provided methodological recommendations on synchronizing the Ukrainian museum register with European repositories and also updated previously developed recommendations on copyright compliance when digitizing museum collections.

     

    Another outcome of the cooperation between the Ministry of Culture and UANIPIO was the inclusion of the institution in the implementation of operational plans for strategies for the development of culture in Ukraine and the development of book reading in Ukraine for the coming years. At the same time, the educational work with Ukrainian museums, which began in 2023, continues, and at their request, UANIPIO continues to hold seminars on copyright compliance in the work of institutions preserving cultural heritage.

     

    During the reporting period, UANIPIO’s educational work also focused on raising awareness among representatives of the music industry, particularly with regard to cooperation with Collective Management Organizations (CMOs). Thus, in order to inform the audience about the specifics of CMOs’ work in Ukraine and globally, UANIPIO held a series of professional discussions with representatives of the NGO “Ukrainian Agency for Copyright and Related Rights” (NGO-UACRR) and participated in two seminars organized by the National Philharmonic of Ukraine on establishing cooperation between music authors, concert organizations, and CMOs. These events resulted in the identification of key gaps in communication between CMOs and concert institutions and the initiation of a multilateral dialogue between interested parties.

     

    UANIPIO also became one of the co-organizers of the national forum-dialogue “Ukrainian Music Industry: Listen, Protect Your Own” — a special event under the patronage of the Office of the President of Ukraine, which brought together representatives of the music industry, government agencies, industry stakeholders, and experts. The forum was dedicated to discussing the role of Ukrainian music as a cultural and economic force, as well as developing common approaches to the development and protection of the national music industry in the context of countering russia’s aggressive cultural and information policy.

     

    UANIPIO and the NGO “Ukrainian Agency for Copyright and Related Rights” (UACRR) have begun cooperation and created a joint educational project, United for IP, designed to provide authors and creators with more information about copyright and its protection.

     

    In addition, UANIPIO participates in joint work on a Large National Language Model (LLM). Together with the Ministry of Digital Transformation of Ukraine and WINWIN AI Center of Excellence, issues related to the observance of intellectual property rights arising from the promising development and machine learning of the national LLM were discussed, as well as the prospects for partnership and implementation of the WINWIN 2030 Strategy Operational Plan.

     

    In total, during 2025, the advisory assistance sector of the UANIPIO provided more than 4,200 consultations to representatives of the creative sectors of the economy on a wide range of issues related to IP rights protection. In addition to traditional questions about copyright registration, the most frequent requests from applicants concerned the regulation of relations regarding objects generated by artificial intelligence, the transfer of property copyrights by inheritance, the specifics of the transfer (alienation) of property copyrights, the work of CMOs, and the licensing of copyright objects.

     

    Among the new support tools, it is also worth noting the opportunity to receive consultations from UANIPIO’s specialists through the “Diia. Bussines” service.
