    Indicators of the investigation and consideration of IP cases have returned to pre–russia’s full-scale invasion of Ukraine levels, according to a report by the IPR Monitoring Center

    Throughout 2023, most indicators demonstrate that the investigation and consideration of intellectual property protection cases returned to levels observed prior to russia’s full-scale invasion of Ukraine.

     

    This is supported by data from the IP Office’s Intellectual Property Rights Infringement Monitoring Center report Statistics on the Investigation and Consideration of Intellectual Property Cases for 2019–2023:

     

     

    Statistical data indicate that the activities of state authorities responsible for enforcing intellectual property rights closely reflect events in Ukraine that affected these figures. In 2020, this coincided with the introduction of quarantine measures due to the COVID-19 pandemic, while 2022 marked the beginning of the full-scale invasion of Ukraine by the russian federation. As a result, statistical indicators declined significantly during the years that destabilized the country’s situation. Although the indicators have not fully returned to pre-2022 levels, 2023 demonstrates a notable recovery.

     

    The data for the report were obtained at the request of the IP Office from relevant state authorities or from publicly available sources.

     

    Courts

     

    Statistics from local and appellate courts, as well as the Supreme Court, show a decline in the number of cases in 2020 and 2022 and an increase in 2021 and 2023. However, the figures have not yet returned to pre-war levels.

     

    In local courts, the majority of disputes concern copyright and related rights (56%) and trademark rights (27%).

     

    A significantly smaller share of cases relates to rights to inventions, utility models, and industrial designs (13.5%), while disputes concerning prior use rights account for the smallest proportion (3.5%).

     

    Over the period 2019–2023, statistics demonstrate stable dynamics in case consideration, with the share of cases considered exceeding 60%. However, over the past two years, the proportion of cases considered has increased, while the number of pending cases has declined.

     

    The trend in the amount of compensation awarded is directly related to the number of cases considered and the volume of claims filed:

     

    • in 2021, the amount was three times higher;

     

    • in 2022, a record decline was recorded – 8 times lower;

     

    • in 2023, the situation is improving, approaching pre–russia’s full-scale invasion of Ukraine levels.

     

    According to 2023 statistics, cases related to copyright and related rights (44%) and trademarks (41%) follow a nearly identical trend. At the same time, cases concerning rights to inventions, utility models, and industrial designs (15%) are handled three times less often than cases in other categories.

     

    Police

     

    The data indicate a decline in the number of recorded criminal offences from 2019 to 2022. In 2023, the number increased compared to the previous year.

     

    Most of the recorded criminal offences relate to Article 176 and Article 229 of the Criminal Code of Ukraine, while no proceedings were initiated under Article 203-1 in 2022–2023.

     

    Customs Service

     

    As of 31 December 2023, 980 intellectual property objects were registered in the customs register based on applications from rights holders. These include trademarks, industrial designs, inventions, and copyrighted works.

     

    In 2023, the following were registered:

     

    • 144 trademarks, of which 90 are protected under national law and 54 are protected under international law;

     

    • 1 copyrighted work;

     

    • 5 industrial designs, all protected under national law.

     

    After an intellectual property object is registered in the customs register, customs authorities take measures to enforce IP rights based on the data in the register.

     

    From 2019 to 2023, most suspensions were carried out by the Customs Service of Ukraine based on data from the customs register of IP objects, in accordance with Article 399 of the Customs Code of Ukraine. This underscores the importance of rights holders registering their IP objects in the customs register.

     

    During 2022–2023, the number of protocols on customs violations decreased, while cases involving label changes remained relatively stable and at a minimal level.
