For the first time in Ukraine, proprietary rights to musical works belonging to a sanctioned individual have been transferred to the ownership of the State.

The Ukrainian National Office for Intellectual Property and Innovations (UANIPIO/IP Office) registered the proprietary rights in the music and lyrics of nine songs, previously owned by former Ukrainian singer Taisiia Povalii, in the name of the State of Ukraine, represented by the State Property Fund of Ukraine (SPFU).

The relevant information was published on August 29, 2025 in the official electronic bulletin Copyright and Related Rights No. 92, as well as in the UANIPIO Special Information System (SIS).

This registration was carried out in execution of the decision of the High Anti-Corruption Court (HACC), upheld by the resolution of the HACC Appeals Chamber, in case No. 991/8552/24 concerning the transfer to the State’s revenue of proprietary rights in the music and lyrics of nine songs that belonged to Taisiia Povalii.

The list of these works includes: “Обниму тебя”, “Любить, понимать и слушать”, “Ангелы-хранители”, “Назавжди”, “Просто я хочу”, “Бусинки любви”, “Больше чем близко”, “Я лечу в даль с тобой синюю”, “Доброе утро”. The proprietary rights to these works had been assigned to Povalii by the songwriters under assignment agreements.

This decision became possible through the application of the provisions of the Law of Ukraine “On Sanctions”, in particular paragraph 1-1 of part 1 of Article 4, which provides for the transfer to the State’s revenue of assets belonging to natural or legal persons who support russia’s armed aggression against Ukraine.

“These are among the first state copyright registrations in the name of the State Property Fund of Ukraine for works seized as a result of sanctions. They demonstrate how the sanctions mechanism actually works and allows for converting the assets of sanctioned persons into a resource for the State” – commented Liubov Maidanyk, Deputy Director of UANIPIO.
