On September 26, the second day of the mock session was held to prepare Ukrainian negotiators for further meetings with the European Commission.

 

The second day of the mock session of the bilateral meeting between Ukraine and the European Commission, as part of the official screening on the Ukrainian legislation compliance with EU acquis under negotiating Chapter 7: “Intellectual Property Law”, was devoted to copyright, related rights and the issue of semiconductor product layouts.

 

The Ministry of Economy of Ukraine was represented by Inna Shatova, Deputy Head of the Intellectual Property and Innovations Department, Head of the IP State Policy Department.

 

The IP office was presented at the mock session by:

 

• Bogdan Paduchak, First Deputy Director;
• Liubov Maidanyk, Deputy Director;
• Mykola Pototskyi, Advisor to the Director;
• Heads of the relevant structural units.

 

Rovena Beqiraj, Drita Abdiu-Halili acted as experts to provide feedback and recommendations to the negotiating parties.

 

 

During the second day, presentations were given on the following Directives:

 

• Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society;

 

• Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC;

 

• Council Directive 93/83/EEC of 27 September 1993 on the coordination of certain rules concerning copyright and rights related to copyright applicable to satellite broadcasting and cable retransmission;

 

• Directive (EU) 2019/789 of the European Parliament and of the Council of 17 April 2019 laying down rules on the exercise of copyright and related rights applicable to certain online transmissions of broadcasting organisations and retransmissions of television and radio programmes, and amending Council Directive 93/83/EEC;

 

• Directive 96/9/EC of the European Parliament and of the Council of 11 March 1996 on the legal protection of databases

 

• Directive 2006/115/EC of the European Parliament and of the Council of 12 December 2006 on rental right and lending right and on certain rights related to copyright in the field of intellectual property repealing and replacing Directive 92/100/EEC.

 

The following issues were also presented:

 

• Collective management of copyright and related rights

 

• Term of protection

 

• Artist’s resale right

 

• Implementation of the Marrakesh Treaty in EU law

 

• Orphan works

 

• Portability

 

• Computer programs

 

These Directives and issues were presented by Liubov Maidanyk.

 

The issue of semiconductor product layouts was presented by Bogdan Paduchak.

 

The mock session will continue tomorrow, September 26, and will focus on copyright, related rights, and semiconductor products layouts.

 

The event was organized with the support of the Government Office for Coordination of European and Euro-Atlantic Integration and the Reform Support Team (RST) of the Ministry of Economy.
