    AI’s impact on Copyright and Exceptions and Limitations to Copyright for People with Disabilities – Ukraine’s Statement at the WIPO General Assembly

     

    Ukraine supports the debate on generative artificial intelligence (AI), as this technology has the potential to change existing copyright paradigms. In this regard, it is very important to recognize the prospect of even greater use of generative AI in various fields. At the same time, it is necessary to consider the potential risks and opportunities for the creative industries.

     

    This was emphasized by the First Deputy Director of the Ukrainian IP Office Bogdan Paduchak during the 65th series of meetings of the Assemblies of the Member States of the World Intellectual Property Organization (WIPO), in which the Ukrainian delegation takes an active part.

     

    This statement was made by the representative of the Ukrainian delegation on July 11, 2024, during the consideration of agenda item 10 (i) “The Standing Committee on Copyright and Related Rights (SCCR Committee)”.

     

    According to him, the SCCR Committee has done a significant amount of work to achieve enhanced and updated protection of the rights of broadcasting organizations, improve approaches to exceptions and limitations in copyright, and address a number of other global copyright issues.

     

    “During the previous SCCR Committee, we were pleased to share the Ukrainian experience in introducing sui generis rights to non-original objects generated by computer programs. Also, as a country that is actively harmonizing its national legislation with the EU legislation, we are interested in further discussions on harmonization of national and regional legislation”, – noted Bogdan Paduchak.

     

    He also welcomed further discussion of new instruments for implementing the Marrakesh Treaty, as the issue of enforcement and support for people with disabilities is extremely important for Ukraine, given the devastating consequences of the Russian war of aggression against Ukraine.

     

    Bogdan Paduchak expressed his gratitude to WIPO, Deputy Director General Sylvia Forbin and the WIPO Copyright Division for their invaluable assistance in improving Ukrainian copyright and related rights legislation and mechanisms of functioning of collective management organizations.
