    Effective management and enforcement in the field of copyright and related rights: a new level of cooperation between the UACRR and the IP Office

     

    Enhancing the effectiveness of legal protection for authors and rightsholders in Ukraine and globally, engaging in the discussion on legislative changes and maintaining constant communication with stakeholders ‒ the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO/IP Office) and the NGO “Ukrainian Agency for Copyright and Related Rights” (UACRR) have agreed to work together. The intentions have been documented in the memorandum.

     

    The memorandum provides a basis for a systematic cooperation between UANIPIO and UACRR and will contribute to the further development of the national system for the protection of copyright and related rights in alignment with international standards. Particular attention is paid to the functioning of the collective management system for copyright and related rights.

     

    The cooperation, in particular, provides for:

     

    • involvement of the UACRR in discussing proposals for amendments to legislation in the field of copyright and related rights (to the Law of Ukraine “On Effective Management of Property Rights of Rightsholders in the Field of Copyright and (or) Related Rights” and the Law of Ukraine “On Copyright and Related Rights”);

     

    • participation in events at international and regional platforms on the protection and enforcement of copyright and related rights;

     

    • development and implementation of joint educational and communication activities for authors, rightsholders, users of copyright and related rights objects, as well as representatives of creative industries;

     

    • organizing and conducting joint events, information campaigns, and social projects aimed at developing and promoting the Ukrainian music industry.

     

     

    According to Olena Orliuk, Director of UANIPIO, institutional cooperation between the UACRR and the IP Office began several years ago, but intensified in last May during the forum-dialogue “Ukrainian Music Industry: Listen, Protect What’s Yours” and continued, in particular, in the joint educational project United for IP, which aims to provide authors and creators with more information about copyright and its protection.

     

    “The cooperation envisaged in the memorandum has a practical goal — to strengthen the protection of Ukrainian authors and make the rights management system understandable and effective. Author must be confident that their work is protected and that its use is transparent and fair. Our common task is to develop effective rights management mechanisms, ensure proper remuneration, and raise awareness among creators about their opportunities. When the system works effectively, author can focus on their creativity rather than on resolving legal issues. This strengthens both the economic position of creative industries and Ukraine’s cultural presence globally,” emphasized Olena Orliuk.

     

    Serhii Shapoval, Executive Director of the UACRR, noted:

     

    “The signing of the memorandum with the IP Office is a systematic step towards the formation of a transparent and effective model of collective management in Ukraine. It is fundamentally important for us that the position of the author community is institutionally taken into account in the process of preparing legislative changes, and that the regulatory environment aligns with international standards and modern market practices.

     

    Deepening cooperation with UANIPIO will contribute to improving the level of legal protection for Ukrainian authors at both the national and international levels, as well as create the conditions for ensuring fair and transparent remuneration for the use of copyrighted works.

     

    We are convinced that it is through constructive dialogue and partnership between the State and the professional community that it is possible to ensure the sustainable development and competitiveness of the music industry in Ukraine.”

     

    For reference:

     

    UACRR is a collective management organization representing authors of musical, literary, dramatic, and other works of art and science. The organization manages the property rights of Ukrainian authors and represents the interests of foreign rightsholders in Ukraine on the basis of mutual representation agreements with foreign copyright organizations.
