    Implementation of EU Acquis on Trade Marks into Ukrainian Legislation: UANIPIO Holds Second Round of Discussion

     

    On 18 June 2025, the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO, or the Ukrainian IP Office) held a second expert discussion in a hybrid format on proposals for the implementation of Directive (EU) of the European Parliament and of the Council of the European Union No. 2015/2436 of 16 December 2015 to approximate the laws of the Member States relating to trade marks and to ensure the enforcement of Regulation (EU) No. 2017/1001 of the European Parliament and of the Council of the European Union of 14 June 2017 on the European Union trade mark.

     

     

    The event was attended by almost 100 participants, including representatives of:

     

     

     

     

     

     

     

     

     

     

    • All-Ukrainian Association of Patent Attorneys.

     

     

     

    Representatives of the Ukrainian IP Office presented proposals for the draft Law of Ukraine, “On the Protection of Trademark Rights,” updated based on the results of a professional discussion of this draft, which took place on 14 May 2025 at the UANIPIO premises, and the processing of comments from the professional community regarding:

     

    • peculiarities of the representation of legal entities before the National Intellectual Property Authority (NIPA);

     

    • procedure for granting permission to include in a trade mark designations that depict or imitate the official full or abbreviated name, or international letter code of the State of Ukraine, and/or imitate the Small State Emblem of Ukraine;

     

    • procedure for filing an application for a trade mark for national registration and the time limits for paying the application fee;

     

    • procedure for establishing priority;

     

    • procedure and time limits for examination of applications, including the submission of observations by third parties and oppositions to trademark registration;

     

    • features of conducting an examination of international registrations;

     

    • procedure for calculating the time limits for the start of genuine use of a trade mark in Ukraine;

     

    • procedure for invalidation and revocation of a trade mark registration by the NIPA and by the courts;

     

    • procedure for appealing decisions and notifications of the NIPA;

     

    • competence of the High Intellectual Property Court;

     

    • procedures before the NIPA;

     

    • powers and status of the NIPA.

    The proposals to the draft Law, consolidated following the results of the second discussion, will be sent for comments to international experts of the international technical assistance project, “Strengthening Intellectual Property Rights in Moldova and Ukraine” (EU4IP). The EU4IP project is funded by the European Union jointly with the European Union Intellectual Property Office (EUIPO) and has been registered with the Secretariat of the Cabinet of Ministers of Ukraine under No. 5576.

     

    In July 2025, the finalised draft Law will be sent to the European Commission for recommendations and/or comments.
