Within the framework of the Reinforced Technical and Strategic Partnership, a meeting was held between the representatives of the Ukrainian IP Office (UANIPIO) and the European Patent Office (EPO) to discuss further harmonization of national and European practices of protection of inventions and utility models.
The meeting was organized to facilitate preparations for the official bilateral screening meetings between Ukraine and European Commission on alignment of Ukraine’s legislation with the EU acquis under Chapter 7 “Intellectual Property Law”. The screening process requires careful analysis by the Ukrainian side, as a proper assessment of the level of harmonisation of our legal and administrative framework with EU standards and international best practices in the IP field will help us move further towards accession.
The discussion also focused on amendments to the national patent legislation in 2020, which already included certain provisions of the European Patent Convention (EPC), as well as the level of compliance with the EPC and EPC Guidelines in the process of drafting a new version of the Rules for Drafting, Filing and Examining of Invention and Utility Model Applications, approved by the Order of the Ministry of Economy of Ukraine dated 09.09.2024 No. 23301 and registered with the Ministry of Justice of Ukraine on 18.09.2024 No. 1411/42756.
The Memorandum on Reinforced Technical and Strategic Partnership between UANIPIO and EPO, signed in 12 July 2023, and the EU4IP project ‘Strengthening Intellectual Property Rights in Georgia, Moldova and Ukraine’, funded by the EU, provide an effective opportunity for Ukrainian IP stakeholders to participate in experience exchange events, as well as to hold relevant technical consultations and discussions with representatives of European IP offices on the harmonization of practices and national legislation.
