Experts of the Intellectual Property Rights Infringement Monitoring Center (IPR Monitoring Center) under the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO) have prepared a document containing proposals aimed at enhancing the intellectual property rights protection system in Ukraine.
The document was developed within the framework of the implementation of the Action Plan for fulfilling the recommendations of the European Commission, as presented in the Ukraine Progress Report under the European Union Enlargement Package 2024.
The document consists of several key components:
- An assessment of the current state of the intellectual property rights protection system, including an analysis of the legislative framework, the activities of key institutions, statistical data on intellectual property rights infringements, and the effectiveness of enforcement during the period 2019 – 2024.
- An examination of the main challenges requiring resolution, including the absence of a specialised intellectual property court, deficiencies in administrative procedures, the limited effectiveness of criminal and customs enforcement, as well as challenges posed by the digital environment.
- Consideration of the provisions of European Commission Recommendation C(2024) 1739 on strengthening the protection of intellectual property rights, in particular the need to improve coordination, introduce dynamic injunctions, enhance cooperation with online platforms, and increase the level of legal education.
- Proposals aimed at harmonising Ukrainian legislation with the EU acquis, including in the areas of copyright and related rights, trade secrets, as well as the development of pre-trial and administrative protection mechanisms.
- Proposed measures to enhance the effectiveness of enforcement, including strengthening customs control, improving criminal-law responses, and developing tools to combat infringements in the digital environment, in particular online piracy.
- Particular emphasis is placed on the development of information exchange, digital services, analytical activities, and raising awareness among right holders.
