Ukraine has some level of preparation in the area of intellectual property law. This is stated in the European Commission Report on Ukraine within the framework of the 2025 EU Enlargement Package (Ukraine Report 2025), published on November 4, 2025. The document states that some progress has been made, in particular through the development of draft laws on copyright, patents, trade marks and trade secrets.
The European Commission noted that the Ukrainian authorities have prepared a draft law on copyright and related rights aimed at further increasing the alignment with the EU legislation (acquis). At the same time, the issue of suspending accreditation procedures for collective management organizations (CMOs) under martial law remains problematic, which negatively affects the collection and distribution of royalties to copyright holders.
The document notes that the Rules for drafting, filing and examining the patent application and utility model application came into force in October 2024, and the respective Guidelines were approved in May 2025.
Order of the Ministry of Economy of Ukraine “On Approval of the Procedure for Consideration of the Application for Supplementary Protection for Rights to Inventions” No. 1803 dated March 19, 2025 came into force in June 2025.
At the same time, the European Commission points out the need for further alignment to EU standards, in particular regarding a supplementary protection certificate (SPC) for medicinal and plant protection products, compulsory licensing of pharmaceutical patents and biotechnological inventions.
It is also indicated that the new Rules for drafting and filling a trademark application came into force in September 2024.
In the spring of 2025, a Law was passed that resumed pre-war standard timelines for actions related to intellectual property rights, such as submitting of documents, paying fees, providing responses to Office notifications, and renewing timelines.
On June 30, 2025, the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO) published consolidated data on the State of Intellectual Property Rights Enforcement in 2024. The report emphasizes that the number of cases related to infringements of intellectual property rights has decreased compared to the previous year.
The European Commission noted the work of UANIPIO, in particular, on conducting technical trainings, information campaigns and signing Memoranda on Understanding with the relevant authorities. At the same time, it is noted that the High IP Court is still not operational.
The report highlights the continued close collaboration between UANIPIO and the European Union Intellectual Property Office (EUIPO).
In particular, Ukraine has started integration with the tools and Common practice of the European Intellectual Property Network (EUIPN), as well as completed the integration of data on national trade marks (via the API of the Special information system of UANIPIO (SIS)) into the EUIPO TMView databases.
The European Commission recalled that the recommendations made last year remain in force.
